General terms and conditions for orders placed via the Motech website as well as for direct orders by email or other channels.
1. Scope
These general terms and conditions apply to orders placed via the Motech website as well as to direct orders by email or other channels, unless otherwise agreed in writing.
By placing an order the buyer accepts these terms.

3. Products
Motech sells smart motorcycle hardware, in particular:
- folding plate holders
- bar buttons
- Relay Boxes
- accessories and spare parts
Products can be configured depending on motorcycle, variant, material, hanger and accessories.
Product images are for illustration. Minor differences in color, surface, material texture, print or shape are possible as long as the function is not materially impaired.
4. Use and road traffic
The folding function of the plate holder is not intended for public road use. It may only be used on private property, race tracks or closed areas, where locally allowed.
Tail light and plate light may carry an E-mark. This does not automatically mean that the folding function or the overall conversion is permitted on public roads.
The buyer is responsible for checking and complying with the legal regulations in their own country.
5. Relay Box and electrical installation
The Relay Box is designed for freely assignable relay functions. Which function is connected to which relay depends on the specific motorcycle and the wiring.
Installation requires basic motorcycle electrical knowledge. Incorrect wiring can cause malfunctions or damage to the vehicle.
If unsure, installation should be carried out by a qualified person or workshop.
On motorcycles with an immobiliser, key chip or transponder, the ignition cannot be fully replaced, as the ECU may expect the original chip.
6. Conclusion of contract
The presentation of products on the website is not a legally binding offer but an invitation to order.
The buyer places a binding order by completing the order or making the payment.
The contract is concluded when Motech confirms the order or ships the goods.
Motech may reject or cancel an order if a product is unavailable, a pricing error exists, the information provided is incomplete, or for any other valid reason.
Amounts already paid will be refunded in such cases.
7. Prices and currencies
All prices are shown in the currency displayed in the shop.
Shipping costs, customs duties, import taxes and other charges are only included if expressly indicated.
Shipping costs are shown separately before checkout.
8. Payment
Payment is processed via Stripe or via the payment methods shown during checkout.
Available payment methods may vary depending on country, device and availability.
Orders are typically processed only after the payment has been successfully completed.
9. Delivery
Deliveries are made to the address provided by the buyer.
The buyer is responsible for ensuring that the shipping address is complete and correct.
Delivery time is typically approx. 2-3 weeks. Delivery times are estimates and may vary depending on availability, production, carrier, customs or other circumstances.
Motech will inform the buyer in case of major delays.
10. Customs, import and international orders
For deliveries outside Switzerland, customs duties, import taxes, processing fees or other charges may apply.
These costs are not included in the product price unless explicitly shown during checkout.
The buyer is responsible as the importer for all fees, regulations and approvals in the destination country.
If a shipment is returned due to unpaid import fees, wrong address or refusal of delivery, any incurred shipping, return shipping, customs or processing costs may be deducted from the refund amount.
11. Returns Switzerland
In Switzerland there is no statutory right of return or withdrawal for non-defective products purchased online. Motech does not grant a voluntary 14-day right of return either.
Returns are only possible in individual cases after prior agreement with Motech. Motech decides case by case whether a return is accepted.
Excluded in particular are products that:
- have been mounted or wired
- have been used or show visible signs of use
- are damaged or incomplete
- are not returned in the original packaging
- were made as customer-specific one-off items
If Motech accepts a return, the buyer bears the return shipping costs, unless Motech delivered an incorrect or defective item. Shipping costs are not refunded unless the error is on Motech's side.
For defective products, the statutory warranty rights apply additionally.
12. Right of withdrawal EU/EEA
If Motech sells and delivers to consumers in the EU or EEA, the mandatory consumer rights of the respective country apply additionally.
EU/EEA consumers may generally withdraw from the contract within 14 days of receipt of the goods without giving any reason.
The withdrawal must be declared unambiguously, for example by email to info@motechapp.com.
After withdrawal, the goods must be returned within 14 days.
The buyer bears the return shipping costs, unless otherwise agreed.
Motech may withhold reimbursement until the goods have been received back or the buyer has provided evidence of having sent the goods back.
The buyer may be liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning, to the extent permitted by law.
For individually manufactured custom parts or customer-specific one-off items, the right of withdrawal may be excluded to the extent permitted by law.
13. Defects and technical issues
If a product is defective or does not work as described, the buyer should contact Motech as soon as possible.
Please include photos, videos, order number and a short description of the issue if possible.
Motech will review the case and may offer repair, replacement delivery, spare-part delivery, technical support or refund depending on the situation.
No defect found
If a product is returned due to a suspected defect and no defect can be confirmed during inspection, the customer bears the resulting costs. This includes in particular return shipping costs, repeat shipping costs, customs duties, import fees and processing fees.
This also applies if the issue was caused by missing app permissions, wrong settings, incorrect installation, incorrect wiring, operating errors or other customer-side causes.
No warranty applies to damage or issues caused by:
- incorrect installation
- incorrect wiring
- use contrary to the instructions
- modifications to the product
- mechanical damage
- crash, accident or improper use
- short circuit, wrong voltage or faulty power supply
- use on public roads contrary to local regulations
- normal wear and tear
Mandatory statutory rights of the buyer remain reserved.
14. Statutory warranty (legal liability for defects)
Statutory warranty rights apply. For buyers in Switzerland, these are governed by Art. 197 ff. of the Swiss Code of Obligations. For consumers in the EU/EEA, the period of liability for defects is at least two years from delivery pursuant to the Sale of Goods Directive (EU) 2019/771 and the respective national implementation.
If a defect exists, the buyer is entitled to remedy, replacement, price reduction or rescission within the scope provided by law.
Defects must be reported to Motech without undue delay after discovery, with a description and if possible photos or a short video: info@motechapp.com
Statutory warranty does not cover damage caused by incorrect installation, improper use, manipulation, third-party interference or normal wear and tear.
14a. Voluntary guarantee
Motech does not offer a voluntary guarantee beyond the statutory warranty, unless explicitly stated for the respective product.
Regardless of that, Motech supports customers with technical issues pragmatically and solution-oriented.
15. Liability
Motech is liable only for direct damages caused by intentional or grossly negligent conduct of Motech, to the extent permitted by law.
Motech is not liable for damages to the motorcycle, electronics, attached parts or consequential damages caused by incorrect installation, incorrect wiring, improper use, modifications to the product or non-compliance with the instructions.
Liability for personal injury and mandatory statutory liability remain reserved.
16. App and software
The Motech App is used to control compatible Motech products.
Bluetooth and the necessary system permissions are required for the connection.
The iOS app is available through the Apple App Store. The Android app may be available as a beta depending on status.
Beta versions may contain bugs, be available with limitations or require additional sign-up.
Motech may further develop, change or improve app features. A compatible smartphone and a current operating system may be required.
17. Privacy
Information on the processing of personal data can be found in Motech's privacy policy.
18. Changes to the terms
Motech may amend these terms if products, processes, technical functions or legal requirements change.
The terms applicable to an order are those published at the time the order was placed.
19. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection provisions of another country apply.
Place of jurisdiction is the registered office of Motech. For consumers in the EU/EEA, this jurisdiction clause does not apply where mandatory law (in particular the Rome I and Brussels Ia regulations) protects the consumer: in such cases the consumer may also sue and be sued at their place of residence.
